These terms apply when you use the Seeking Optimal website or buy any of our coaching programs. Seeking Optimal is a trading name of Cosnett Training Systems Pty Ltd (ABN 38 166 821 067) ("we", "us", "our"). By booking, paying for or starting a program, you agree to these terms.
1. What we provide
We provide functional nutrition and performance coaching, including blood work interpretation, personalised protocols, check-ins and coaching calls. The details of each program (what's included, its length and its price) are described on our website or agreed with you before you start.
2. Coaching, not medical care
Our services are education and coaching. They are not medical advice, diagnosis or treatment, and they don't replace care from your doctor or other registered health practitioner.
- Blood work interpretation is provided to guide nutrition and lifestyle decisions. It isn't a medical diagnosis.
- Keep seeing your doctor, and talk to them before changing or stopping any medication.
- If something feels wrong or you have new or worsening symptoms, see a doctor. In an emergency, call 000.
- Tell us about any medical conditions, medications, pregnancy or allergies, and let us know if anything changes. Our recommendations depend on the information you give us.
You're responsible for your own health decisions, including whether to follow any recommendation.
3. Eligibility
You must be 18 or older to buy a program. Coaching for anyone under 18 needs a parent or guardian to agree to these terms on their behalf.
4. Discovery calls
Discovery calls are free and carry no obligation.
5. Prices and payment
- Prices are in Australian dollars and shown on our website or agreed with you before you start.
- Payments are processed securely by Stripe. Depending on your program, you pay an upfront amount, a recurring subscription (for example weekly or monthly), or both.
- By starting a subscription, you authorise us to charge your nominated card or bank account at the agreed amount and frequency until your subscription ends.
- If a payment fails, Stripe will automatically retry it and email you a link to update your payment details. If payment stays outstanding, we may pause your coaching until it's resolved.
- We'll give you at least 30 days' notice before changing the price of an ongoing subscription.
6. Minimum commitments and cancellation
Some programs have a minimum commitment, which we'll tell you about before you start. For example, Advanced Coaching has a 4-month minimum.
- After the minimum commitment: your program continues month-to-month, or at the agreed billing frequency, and you can cancel at any time by emailing us. Cancellation takes effect at the end of your current billing period.
- During the minimum commitment: if you need to stop early, contact us. We'll consider each request individually and fairly, taking into account your circumstances.
- Programs without a minimum commitment can be cancelled at any time by emailing us, and cancellation takes effect at the end of the current billing period.
We may end a program if you seriously or repeatedly breach these terms, if payments remain unpaid, or if we believe coaching is no longer appropriate for you (for example, if you need medical care instead). If we end a program for a reason that isn't your fault, we'll refund any amount you've paid for services we haven't provided.
7. Refunds
We don't offer refunds for change of mind, or for sessions or program periods that have already been delivered or paid for.
Your rights under the Australian Consumer Law aren't affected. Our services come with guarantees that can't be excluded under the Australian Consumer Law, including that they'll be provided with due care and skill. If we fail to meet those guarantees, you're entitled to a remedy. Nothing in these terms limits those rights.
8. Results
Everyone's body is different. We'll do our best to help you reach your goals, but we can't guarantee specific health outcomes, test results or timeframes. Results depend on many factors, including how closely the protocol is followed.
9. Your responsibilities
- Give us accurate and complete information.
- Follow product labels and directions, and check with your doctor before starting supplements, especially if you're pregnant, breastfeeding, taking medication or have a medical condition.
- Treat coaching materials as being for your personal use only.
10. Intellectual property
Our protocols, guides, quizzes, templates and other materials remain our property. They're provided for your personal use while you're a client. Please don't share, resell or publish them.
11. Liability
To the extent permitted by law, including the Australian Consumer Law, we aren't liable for any indirect or consequential loss arising from our services. Where our liability for a failure to meet a consumer guarantee can be limited, it's limited to supplying the services again or paying the cost of having them supplied again.
12. Privacy
How we handle your personal and health information is explained in our Privacy Policy.
13. Changes to these terms
We may update these terms from time to time. The current version will always be on this page. Changes won't affect a program you've already paid for unless you agree.
14. Governing law
These terms are governed by the laws of Victoria, Australia, and you and we submit to the courts of Victoria.
